1. Acceptance of Terms

By accessing or using the website located at suisuncityasphaltpaving.com (the "Site") or by engaging Suisun City Asphalt Paving ("we", "our", or "us") for any services, you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Site or our services. We may update these terms at any time by posting a revised version on this page. Continued use of the Site after any changes means you accept the revised terms.

2. Description of Services

Suisun City Asphalt Paving is an asphalt paving contractor based in Suisun City, CA. We provide residential and commercial asphalt paving, sealcoating, crack sealing, pothole repair, driveway paving, parking lot paving and striping, resurfacing, milling, grading and excavation, drainage solutions, concrete curbing and sidewalks, and related services within our service area. All services are subject to availability and site suitability as determined by our team.

3. Estimates and Pricing

Estimates are provided at no charge and are based on an on-site evaluation of the work requested. All estimates are valid for 30 days from the date issued unless otherwise stated in writing. An estimate is not a contract or a guarantee of final price.

Final pricing may differ from an estimate if: (a) the scope of work changes at your request; (b) site conditions differ materially from what was visible during the estimate visit; (c) unforeseen conditions are discovered once work begins, such as base failure not visible at the surface, unexpected soil conditions, or buried obstructions; or (d) material costs change significantly between the estimate date and the project start date.

Any price changes beyond the original estimate will be communicated to you before additional work proceeds. We will not charge for additional work without your prior approval.

4. Scheduling and Cancellation

Project dates are scheduled based on availability and weather conditions. Asphalt work requires dry conditions and appropriate temperatures to cure correctly. We reserve the right to reschedule any project if weather conditions are unsuitable, and we will notify you as soon as possible in the event of a delay.

If you need to cancel or reschedule a booked project, please notify us as soon as possible. Cancellations made less than 48 hours before the scheduled start date may result in a fee to cover mobilization costs already incurred. If we have already purchased materials specifically for your project, you may be responsible for the cost of those materials.

We reserve the right to reschedule or cancel a project if site access is blocked, unsafe conditions exist, or permits or approvals have not been obtained in time.

5. Payment Terms

Payment terms are outlined in your written estimate or project agreement. Unless otherwise agreed in writing, payment is due upon completion of the work. For larger commercial projects, progress payments may be required at milestones specified in the project agreement.

We accept payment by check, cash, and other methods as specified in your agreement. We do not require full payment upfront before work begins. Any deposit required will be specified in your written agreement.

Accounts that are not paid within the agreed terms may be subject to a late payment fee. We reserve the right to pursue collection of unpaid balances through available legal means, including filing a mechanics lien on the property as permitted by California law. You agree to pay all reasonable costs of collection, including attorney fees, if applicable.

6. Your Responsibilities

You agree to:

• Provide clear and accurate access to the work area on the scheduled project date.
• Remove vehicles, equipment, and personal property from the work area before the crew arrives.
• Disclose any known underground utilities, irrigation lines, drainage pipes, or other obstructions in or near the work area prior to excavation or grading.
• Obtain any required permits or homeowners association approvals before work begins, unless we have agreed in writing to handle permitting on your behalf.
• Keep people and pets off the freshly completed surface for the full curing period specified by our crew.

We are not responsible for damage to underground utilities or other hidden features that were not disclosed to us prior to the start of work.

7. Warranty and Disclaimers

We stand behind our workmanship. Any warranty applicable to your project will be stated in your written project agreement. In general, our workmanship warranty covers defects in installation that result from errors in our work under normal use and conditions. It does not cover:

• Damage caused by tree roots, ground movement, expansive soils, or other site conditions outside our control.
• Cracking caused by settlement of the underlying base or subgrade over time, particularly in areas with known soil movement.
• Damage caused by heavy vehicle traffic beyond what was described at the time of the estimate.
• Surface damage caused by fuel, oil, chemicals, or cleaning agents applied to the pavement.
• Deterioration caused by failure to maintain the surface as recommended, including failure to sealcoat on a regular schedule.
• Acts of nature, including flooding, earthquake, or severe weather events.

Except for the express workmanship warranty stated in your project agreement, all services are provided "as is." We make no other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Suisun City Asphalt Paving is not liable for any indirect, incidental, consequential, or punitive damages arising out of or related to our services or your use of our Site, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of a specific project shall not exceed the amount paid by you for that project.

9. Website Content

The information on this Site is provided for general informational purposes only. While we make reasonable efforts to keep it accurate and up to date, we make no representations or warranties about the completeness or accuracy of any content on the Site. Nothing on the Site constitutes a binding quote, estimate, or contract. All projects require an on-site evaluation and written agreement before work begins.

10. Dispute Resolution

We prefer to resolve any concerns or disputes directly. If you have a problem with any work we have performed, please contact us first so we have the opportunity to address it. Most issues can be resolved quickly through direct communication.

If a dispute cannot be resolved through direct communication, both parties agree to attempt in good faith to resolve the matter through mediation before filing any legal action. Mediation shall be conducted in Solano County, California. If mediation is unsuccessful, any legal action shall be brought in the appropriate state or federal court with jurisdiction over Solano County, California.

11. Governing Law

These Terms and Conditions are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings arising out of these terms or our services shall be subject to the exclusive jurisdiction of the courts located in Solano County, California.

12. Changes to These Terms

We reserve the right to modify these Terms and Conditions at any time. Changes take effect when posted on this page with an updated effective date. Your continued use of the Site or engagement of our services after changes are posted constitutes acceptance of the revised terms. We encourage you to review this page periodically.
